FTC Demands More Consumer Rights Concerning Data Brokers

In an unusual move, the Federal Trade Commission (FTC) is calling for a new law to allow Americans to review the massive amounts of information about them collected by various internet, smartphone and other technology makers.

The FTC typically prefers to coax companies into adopting voluntary principles, making this request for a new law surprising to many who are familiar with the organization. The FTC’s demand comes barely a month after the Obama administration issued a proposed “consumer Privacy Bill of Rights.”

The FTC’s request comes as part of a 57-page report touching on several topics. In the report, the organization says Congress needs to impose more controls over “data brokers” that profit from the collection and sale of files containing sensitive information that can affect people in a variety of ways. Negative information in the files can affect everything from an individual’s ability to get a job to his or her options for finding a place to live.

“Consumers are often unaware of the existence of these entities, as well as the purposes for which they collect and use data,” the report said.

While we are surprised that the FTC is taking such a strong stance, we are certainly behind its proposal for increased consumer protection. Possession of personal data gives these companies far more power than they should have, especially lacking any oversight.

Florida Consumers in Need of Help Should Call This Number

Florida is a hotbed for fraud, and the state’s consumers may feel they have nowhere to turn to when they need help. Leaders from several Florida state agencies gathered recently as part of National Consumer Protection Week to discuss ways to raise more awareness about what help is available to consumers.

Representatives from the Florida Attorney General’s Office, the Florida Department of Agriculture and Consumer Services and the Department of Financial Services Chief Financial Officer were among those in attendance at the conference.

One of the most important pieces of information to come from the conference was whom consumers should call if they need help: 1-800-Help-FLA (1-800-435-7352). This is the number for the Florida Department of Agriculture and Consumer Services, the organization that oversees the state’s hotline for consumers. It regulates a broad range of businesses, including: business opportunities, motor vehicle repair shops, charitable organizations, Florida Do Not Call, dance studios, pawnshops, health studios, sellers of travel, intrastate movers, game promotions, telemarketing and professional surveyors and mappers.

In 2011, the Agriculture Department’s consumer division received 41,961 complaints and recovered nearly $6 million on behalf of consumers.

The state wants all residents to know that consumer protection is just a phone call away. If you are uncertain or need advice, call the hotline. It could save you many difficulties, and potentially a lot of money.

Scam Protection Company Settles with Florida Attorney General

A Florida company that claims to recover money for consumer fraud victims has agreed to pay up to $205,000 in restitution to settle a consumer protection lawsuit brought by the Florida Attorney General’s Office.

Scammer Guard did not admit any wrongdoing, but the company has agreed to change its marketing practices and will no longer charge upfront fees before helping fraud victims. It will pay an additional $35,000 to cover the legal fees and investigative costs of the Attorney General’s Office.

Scammer Guard’s attorney claims the company is legitimate and that it has recovered more than $231,000 for fraud victims within the last year.

The suit brought by the Attorney General’s Office accused Scammer Guard of misleading prospective clients by claiming to have ties to government agencies and access to information not available to the public.

Attorney General Pam Bondi pointed out that her office does not work with any private organizations to recover funds lost to fraud.

Scammer Guard will no longer represent that it has any affiliation with government agencies. In addition, it will now collect up to 35 percent of any money it recovers for fraud victims instead of charging fees up front.
